The Law
The Hon Neil Brown QC went to the Bar in 1964, was appointed a Queen's Counsel in 1980 and has practised in virtually every area of the law, mainly in commercial, governmental, administrative, alternative dispute resolution (ADR), town planning, employment, intellectual property and industrial relations law.

Mr Brown is now an Adjuct Professor of Law at Murdoch University in Western Australia.He was a notable trial lawyer and appeared in courts at all levels including the High Court of Australia, arbitrations and many administrative tribunals.

In recent years his interest in intellectual property has come to the fore and he has become an expert in Internet law and domain name arbitration. He is widely sought after as an adviser, arbitrator and speaker on domain names in Australia, Europe, the USA and Asia.

He has had a long-term interest and involvement in all forms of ADR, particularly mediation and arbitration. He is a Chartered Arbitrator and a Nationally Accredited Mediator.

He has conducted domestic and international arbitrations, most recently as:

  1. Chairman of a three-person tribunal under the International Chamber of Commerce (ICC) in Paris on the international sale of goods;
  2. sole arbitrator of an interstate dispute arising from an agency agreement;
  3. sole arbitrator of a dispute arising from a consultancy agreement.

He was appointed by the Australian Government to the Panel of Conciliators at the International Centre of Settlement on Investment Disputes (ICSID) at Washington, DC.

He has also been appointed to the World Intellectual Property Organisation (WIPO) Arbitration Centre's List of Neutrals, the Centre's Domain Name Panel and many other arbitration panels.

Also in the field of ADR, he is a Fellow of The Chartered Institute of Arbitrators, a Chartered Arbitrator and:

  • holds the Practitioner's Certificate in Mediation and Conciliation of the Institute of Arbitrators and Mediators Australia
  • is a member of the Institute of Arbitrators and Mediators Australia, LEADR and the Intellectual Property Society of Australia and New Zealand (IPSANZ)
  • is a Fellow of the Australian Centre for International Commercial Arbitration Limited (ACICA), and
  • has taken part in virtually every type of ADR.

In recent years he has also conducted three significant inquiries for the Commonwealth Government of Australia.

The first was an inquiry into the claims of a 'whistleblower' against a bank and its subsequent owners. The Inquiry became a quasi- arbitration, involving evidence, submissions and a report. All parties accepted Mr Brown's recommendations. In the second inquiry, Mr Brown was Chairman of the Consultative Group on Constitutional Change, which assessed public opinion on proposals to reform the Australian Constitution.The third inquiry was a review of a series of inquiries into a military accident.

His recent cases have been on the international sale of goods, a distributorship and several disputes involving builders, engineers and architects.
